RESEARCH PORTAL USER TERMS AND CONDITIONS
In these terms and conditions, “You” and “Your” mean the legal person using Our Portal (as defined below).

The Parks & Green Spaces Research Portal located at www.greenflagaward.org (“Our Portal”) is a portal hosted and operated by Keep Britain Tidy (“KBT”) and managed and administered by KBT in partnership with The University of Leeds (“Leeds”)and The University of Sheffield (Sheffield”)
KBT is registered in England and Wales under company number 3496361 and is a charity registered under number 1071737. Its registered office address is Elizabeth House, The Pier, Wigan, WN3 4EX.
Leeds is a higher education institution incorporated by Royal Charter (registration number RC000658) whose registered office address is at Woodhouse, Leeds, LS2 9JT.
Sheffield is an independent corporation whose company registration number is RC000667 in England, incorporated by Royal Charter. It is an exempt charity regulated by the Office for Students whose registered office address is at Western Bank, Sheffield, S10 2TN.
“We”, “Our”, and “Us” refers to KBT, Leeds and Sheffield.
- By using Our Portal You accept these terms
2.1 By using Our Portal, You confirm that You accept these terms of use and that You agree to comply with them.
2.2 If You do not agree to these terms, You must not use Our Portal.
2.3 We recommend that You print a copy of these terms for future reference.

- We may suspend or withdraw Our Portal
6.1 We do not guarantee that Our Portal, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of Our Portal for business and operational reasons. We will try to give You reasonable notice of any suspension or withdrawal.
6.2 You are also responsible for ensuring that all persons who access Our Portal through Your internet connection or user account are aware of these terms of use and other applicable terms and conditions, and that they comply with them.
- We may transfer this agreement to someone else
We may transfer Our rights and obligations under these terms to another organisation.
- Our Portal is based in the UK
Our Portal is based in the United Kingdom. You are responsible for adherence to all applicable laws and regulations applicable to You in Your location.
- You must keep Your Credentials safe
9.1 If You choose, or You are provided with, a user identification code, password or any other piece of information (“Credential”) as part of Our security procedures, You must treat such information as confidential. You must not disclose it to any third party and You are responsible for the selection and training of any employees or officers permitted to use Your Credentials.
9.2 We have the right to disable any Credentials, whether chosen by You or allocated by us, at any time, if in Our reasonable opinion You have failed to comply with any of the provisions of these terms of use.
9.3 If You know or suspect that anyone other than You or your authorised staff or officers knows Your Credentials, You must promptly notify Us at [email protected] .
- How You may use material on Our Portal
10.1 We collectively are the owner or the licensee of all intellectual property rights in Our Portal (including rights in the nature of copyright, design right, trade mark or database right), and in the material published on it. Those works are protected by copyright laws and treaties around the world and by other laws protecting intellectual property. All such rights are reserved to the fullest extent permitted by law save where and to the extent permitted by these terms of use.
10.2 Materials published on Our Portal provided by third parties are licensed to Us on the terms set out in our terms and conditions for contributors available on Our Portal (“Licence” as defined in those terms and conditions). Pursuant to that Licence we may produce and share Derivative Content (as defined in the Licence) and make content available to You subject to these terms of use.
10.3 If You access material from Our Portal that is subject to the Licence or Derivative Content You may only do so where and to the extent permitted by these terms of use.
10.4 You must not modify any material You have printed, downloaded or otherwise obtained from Our Portal in any way, and You must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
10.5 If you make use of any material obtained from Our Portal You must whenever You display or distribute that material:
- include with the material the information relating to authorship and copyright as displayed with the material on Our Portal and
- cite Our Portal as the source of the material.
10.6 You must not use any part of the content on Our Portal for commercial purposes without obtaining a separate licence to do so from Us.
10.7 If You use any part of Our Portal in breach of these terms of use, Your right to use Our Portal will cease immediately and You must, at Our option, return or destroy any copies of the materials You have made. You will be responsible for any damage or loss caused to Us or to a third party by Your breach of these terms of use.
- Do not rely on information on Our Portal
11.1 The content on Our Portal is provided for general information only. It is not intended to amount to advice on which You should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on Our Portal.
11.2 Although We make reasonable efforts to update the information on Our Portal, We make no representations, warranties or guarantees, whether express or implied, that the content on Our Portal is accurate, complete or up to date.
11.3 We shall not be liable for any loss caused to any person through any action or omission made in reliance on the content on our Portal or any connected content.
- We are not responsible for websites We link to
12.1 Where Our Portal contains links to other Portals and resources provided by third parties, these links are provided for Your information only. Such links should not be interpreted as approval by Us of those linked websites or information You may obtain from them.
12.2 We have no control over the contents of those other websites or resources.
- User-generated content is not approved by Us
This Portal may include information and materials uploaded by other users of the Portal. This information and these materials are not endorsed by Us and are the responsibility of their authors or licensors. The views expressed by users on Our Portal do not represent Our views or values.
- How to complain about content uploaded by other users
If You wish to complain about content uploaded by other users, please contact Us on [email protected].
- Our responsibility for loss or damage suffered by You
15.1 We do not exclude or limit in any way Our liability to You where it would be unlawful to do so. This includes liability for death or personal injury caused by Our negligence or the negligence of Our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.
15.2 Our Portal is provided for personal, academic and professional reference use. It is not to be used or referenced for commercial gain. Furthermore:
- We exclude all implied conditions, warranties, representations or other terms that may apply to Our Portal or any content on it.
- We will not be liable to You for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
- use of, or inability to use, Our Portal; or
- use of or reliance on any content displayed on Our Portal.
- In particular, We will not be liable for:
- loss of profits, sales, business, or revenue;
- business interruption;
- loss of anticipated savings;
- loss of business opportunity, goodwill or reputation; or
- any indirect or consequential loss or damage.
- How We may use Your personal information
16.1 We will only use Your personal information as set out in these terms and Our Privacy Policy.
- We are not responsible for viruses and You must not introduce them
17.1 We do not guarantee that Our Portal will be secure or free from bugs or viruses.
17.2 You are responsible for configuring Your information technology, computer programmes and platform to access Our Portal. You should use Your own virus protection software.
17.3 You must not misuse Our Portal by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to Our Portal, the server on which Our Portal is stored or any server, computer or database connected to Our Portal. You must not attack Our Portal via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, You would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and We will co-operate with those authorities by disclosing Your identity to them. In the event of such a breach, Your right to use Our Portal will cease immediately.
- Rules about linking to Our Portal
18.1 You may link to Our home page or any other page of Our Portal, provided You do so in a way that is fair and legal and does not damage Our reputation or take advantage of it.
18.2 You must not establish a link in such a way as to suggest any form of association, approval or endorsement on Our part where none exists.
18.3 You must not establish a link to Our Portal in any website that is not owned or controlled by You or for which You do not have a valid user account.
18.4 Our Portal must not be framed on any other portal or website
18.5 We reserve the right to withdraw linking permission without notice.
18.6 Any website owned or controlled by You in which You are linking must comply in all respects with the Our content standards set out in Our terms of use for contributors to our Portal. Those Standards are available on Our Portal.

- Which country's laws apply to any disputes?
19.1 These terms of use, their subject matter and their formation, are governed by English law. You and We both agree that the courts of England and Wales will have exclusive jurisdiction in relation to any dispute under or in connection with these terms of use.
- General
20.1 Clause and Schedule headings shall not affect the interpretation of these Terms and Conditions.
20.2 If there is an inconsistency between any of the provisions in the main body of these Terms and Conditions and the Schedule, the provisions in the main body of these Terms and Conditions shall prevail.
20.3 A reference to a statute or statutory provision is a reference to it as amended, extended or re-enacted from time to time.
20.4 Unless the context otherwise requires, words in the singular shall include the plural and those in the plural include the singular.
20.5 A person includes a natural person, corporate or unincorporated body (whether or not having separate legal personality).
20.6 Any words following the terms including, include, in particular, for example or any similar expression shall be construed as illustrative and shall not limit the sense of the words, description, definition, phrase or term preceding those terms.
20.7 This agreement shall be binding on, and ensure to the benefit of, the parties to this agreement and their respective personal representatives, successors and permitted assigns, and references to any party shall include that party's personal representatives, successors and permitted assigns.
